Terms of Service
These terms govern use of the Apex Shift website and orders placed through the online store. By using the site or submitting an order, you agree to these terms.
Website Use
You may use the site only for lawful purposes. You may not interfere with security or operation, access accounts or systems without authorization, introduce malicious code, misuse checkout or support tools, or copy or scrape the site in a manner that violates law or our rights.
Apex Shift may suspend access reasonably believed to threaten customers, the site, or another party. These terms do not limit rights that cannot legally be limited.
Online-Only Store
Apex Shift is an online-only business based in Utah. There is no public retail storefront, pickup counter, or walk-in return counter. Returns must use the written authorization and destination supplied for the approved request.
Product Information & Pricing
We work to present accurate titles, manufacturer part numbers, descriptions, images, specifications, fitment, availability, and pricing. Manufacturers and suppliers may revise products, packaging, specifications, or availability, and errors can occur.
Before accepting an order, Apex Shift may correct an error, request confirmation, or cancel an affected item and issue any required refund. Product-specific disclosures shown before purchase form part of the order terms.
Orders, Acceptance & Payment
Submitting an order is an offer to buy. An order confirmation acknowledges receipt but does not guarantee acceptance. Acceptance occurs when Apex Shift confirms or begins fulfillment. We may decline or cancel an order for unavailable inventory, an obvious pricing or description error, payment failure, suspected fraud, legal restrictions, or supplier limitations.
Shopify and its payment providers process checkout. You authorize the charges presented at checkout, including applicable tax and shipping. If an accepted order cannot be fulfilled, the affected charge will be canceled or refunded.
Availability, Shipping, Returns & Refunds
Availability and processing labels are estimates based on the product or variant status shown at the time of purchase. Processing is separate from carrier transit, and delivery dates are not guaranteed.
Return requests must be submitted within the stated window and are not approved until written authorization is issued. Eligibility, condition requirements, shipping responsibility, refund timing, and any product-specific restriction are governed by the Shipping & Returns policy shown before purchase.
Fitment, Installation & Legal Use
Fitment tools and support provide decision context but are not a blanket compatibility guarantee. Before ordering or installation, verify the exact manufacturer part number and application for the vehicle's year, make, model, trim, engine, transmission, drivetrain, market, and modifications.
Aftermarket parts can change vehicle behavior, emissions compliance, warranty coverage, and road legality. Follow manufacturer instructions and applicable laws. Use a qualified installer when appropriate; stop before installation and contact support if the product or application appears incorrect.
Manufacturer Warranties & Customer Rights
Manufacturer warranty coverage, if any, is specific to the exact product and application. Apex Shift may help route a claim but does not expand, replace, or guarantee a manufacturer's coverage.
Except for an express written commitment made by Apex Shift, product warranties are provided by the manufacturer, if offered. Nothing in these terms excludes statutory warranties, consumer remedies, or other rights that cannot be waived under applicable law.
Limitation of Liability
To the maximum extent permitted by law, Apex Shift is not responsible for indirect, incidental, special, exemplary, or consequential loss arising from site use or a product, including loss caused by improper selection, installation, modification, maintenance, or use contrary to instructions.
Where liability may lawfully be limited, Apex Shift's aggregate liability for a claim relating to an order will not exceed the amount paid for the affected product. This limitation does not apply to liability or remedies that applicable law does not allow us to exclude or limit.
Intellectual Property
Site text, design, graphics, photographs, software, and Apex Shift branding are owned by Apex Shift or used with permission and are protected by applicable law. Manufacturer names, product names, and third-party marks remain the property of their respective owners and are used for identification.
Governing Law
These terms are governed by Utah law, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise. Any permitted court proceeding will be brought in a court with jurisdiction in Utah, subject to any non-waivable right to another venue.
Changes, Severability & Entire Agreement
We may update these terms prospectively by posting a revised version. The terms presented for an order at purchase govern that order except where law requires otherwise.
If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. These terms, the policies linked from them, and product-specific disclosures are the agreement for site use and purchases, except for another written agreement that expressly applies.
